There is no single federal flavor ban on e-cigarettes in the United States. Instead, flavor restrictions are written at the state and local level, which means a product that is legal in one state can be unlawful a short drive across the border.
California is one of the clearest examples. SB 793 prohibits the sale of most flavored tobacco products, including flavored vapes, while leaving tobacco-flavored offerings within the rules. Other states and municipalities have adopted their own wording, and some extend the restriction to menthol or to specific product categories such as disposables.
For a retailer operating more than one location, or buying for stores in different states, the safe approach is to manage SKUs against the rules of each sales territory rather than keeping one national product list. A distributor that understands the territory should be able to confirm which of its products are permitted there.
