The Premarket Tobacco Product Application, or PMTA, is the federal process that decides whether a vape product may lawfully be sold in the United States. Before a new tobacco product can be marketed, its manufacturer must submit a PMTA and receive an authorization order from the FDA. Products sold without that order are treated as unauthorized, even if they look identical to legitimate goods on the shelf.
For retailers, the practical effect is simple: the authorization status of a product should be checked before you buy it, not after a problem arrives. The FDA maintains a public list of products that have received marketing authorization, and it is the most reliable reference for confirming whether a device, pod or e-liquid is allowed to be sold.
Unauthorized products carry real downstream risk. Imported goods without a valid pathway can be stopped at the border under Import Alert 98-06, and domestic enforcement increasingly targets retailers as well as makers. Buying through a distributor that can demonstrate a clean compliance chain is the easiest way to avoid taking that risk.
You can find the full framework, including the authorization requirement and the import alert, on the U.S. compliance centre, and compare verified distributors on the wholesalers directory.
