PACT Act and the USPS Vape Ban: A Retailer Compliance Guide

TrackElf Team · 20 Oct 2026 · 5 min

The Prevent All Cigarette Trafficking Act, known as the PACT Act, was extended to cover electronic nicotine delivery systems. It requires sellers to register, file regular reports, and comply with tax and delivery obligations that did not previously apply to online vape sales.

One of the best-known consequences is the postal restriction. The United States Postal Service is barred from carrying vapes, so sellers cannot rely on USPS for delivery. Private carriers may still move the products, but only where the relevant delivery conditions, including age verification on handover, are met.

The delivery sale rules matter for any store that ships to customers. They generally require an adult signature at delivery, collection of the applicable taxes, and record-keeping that ties each shipment to a verified buyer. Ignoring these conditions exposes both the seller and the distributor supplying the goods.

The compliance centre sets out the PACT Act registration requirements, the USPS ban and delivery sale conditions. When choosing a supplier, confirm it can meet these obligations using the wholesalers directory.
